Can I sue someone or have charges filed against them for defamation of character, harassment or public slander?

For the past 2 years, my boyfriends ex has been using Facebook to say horrible, untrue things about me. She's been telling everyone my business, spreading lies about me & making me look like a very bad person. She's gotten other people involved &, despite me asking her many times to stop it, she continues . She's even harassed my little girl & said these things to her, making her cry. It's becoming very stressful for me, my children & my boyfriend. I've blocked her on FB & don't communicate with her AT ALL but she's gone on to trouble making now since I try to ignore her. People are angry w/me with things she says I said or did- which I didn't. Some people I don't even know. She left him, I came in a year after they divorced & have been nice so I don't know why she's doing this to me.

I'm not sure that your BF's ex has committed any crime, since it appears she has not been contacting you directly. However, you may have a cause of action for defamation and/or false light breach of privacy. The problem is that it is hard to put a dollar figure on the damages she has cause you, so it would be hard for an attorney to take your case on contingency. Also, if all the girl is doing is stating her opinion and/or saying things that are true but embarrassing, you may not have much of a case.

To prove defamation you have to prove that she made statements about you to other people, that the statements were false, that she knew they were false or at least was malicious enough to disregard the likelihood they were false, that someone believed what she said, and that as a result you were harmed. It does not have to be financial harm. I don't know what was said, but Maryland still has defamation per se if she accused you of a crime, in which case damages can be presumed but you still need to persuade a jury what the damages were worth. I recently took a case for a friend and won a few thousand dollars based on the lies having caused his girlfriend to break up with him.
