When I was hired in 2000, I did not have to fill out an application or anything. I had been at my previous employer about 6 months, BUT the employer before that, I had some issues with and ended up with a criminal record, went to court, unsupervised probation for 3 years and my current employer knows nothing about this. Today he gives myself and the other 3 employees an employment application to fill out and a paper stating he is going to perform backgrounds checks on us. On the application, it states - have you ever been convicted of a crime - I have honestly tried to put all of this behind me and move on with my life. If I answer yes - I have to explain everything , if I answer no - and he finds out with the background check, then I will get fired. Oh, this happened in another state,

An employer can terminate an employee for any reason as long as it is not based on an impermissible consideration such as race, sex, religion, or national origin. In other words, an employer does not have to search for a reason to terminate an employee. However, if an employer were searching for a reason, dishonesty would certainly qualify. Your best bet is to be honest with your employer. Not being honest can only result in you waiting for the axe to fall, creating an issue for yourself on the job.
