I'm 15 years old and this guy was my friend. My other friend who is a girl pretended to be me and set us up. I was honest with him and told him i only saw him as a friend but we went to a party i got drunk and we made out. I accepted in giving him a chance but my mom didnt want us together cause he is 25. Another night we went out dancing and i got drunk. I already knew he wanted sex and my friend promised not to leave me alone. She did! I was hardly able to walk and he took me inside to go to sleep and we started kissing. He than he took my clothes off and by that time i was scared pretending to be asleep. Than i nodded my head no and groaned no but he kept on and he finally went in me and i tried pushin him off and i couldn't.He raped me.I want him in jail but how much time will he serve
I am very sorry to hear of your attack. This individual will serve many years in prison, no doubt. This will be prosecuted as a child molest/ rape case and depending on TX laws, he will serve significant time. I recommend you ask these questions of the prosecutor handling your case, and do not post any more information about the case online.
If this has not been reported to law enforcement, you need to do that. It is a crime for an adult to have sex with a child in Texas. Even if you had consented, it would have been a serious crime for a 25 year old to have sex with you when you are 15.
How much time? If a person is convicted of sexual assault of a child, they have to serve at least 1/2 of their sentence as calendar time before they become eligible for parole. And, parole is not a sure thing. So, in your case, if the man got, let's say, 18 years, he'd do at least 9.
The charge is sexual assault of a child because you were under 17 but over 14. The offense carries from 2 to 20 years in prison as punishment.
Even if you had consented he could not lawfully have sex with you because until you are 17, the law does not allow you to consent. The facts of your intoxication as well as his force against you are aggravating and if he serves prison time - which is most likely - the parole board would consider these as factors against release.
