I bought a Pastrami Melt Sandwich from Subway and it had a 2 inch "bony" piece in it. Eating it I broke my tooth. Advise?

Franchisee has never called and just said go my Dentist which I did. Fractured tooth needing Extraction and replacement. I gave owner the bill but he fought with me and said its not his fault, that he will send to the manufacturer. Long story short, a month later and numerous phone calls to Subway Corporate and Manufacturer and I have still yet to be contacted by the manufacturers Insurance or the Franchisee regarding my tooth. It's killing me and I'm upset in the manner they are handling this! Please advise. Thanking you in advance.
If this has been going on too long and feel you are being pushed around, I would suggest filing suit against the franchisee. Depending on the limits in your state and the amount of your bills/losses/damages, you may be able to file suit in small claims court. If you handle this matter without an attorney, you need to make sure you follow all the rules to be able to prove causation and damages.
I am not a Hawii lawyer, but if your damages are less than $5000 you can consider filing a small claims suit. Merely filing suit may be sufficient to cause the defendant to become more responsive. If not, be prepared to go to trial and prove your case. Alternatively, hire a lawyer to write a demand letter and/or file suit. Good luck.
You should at least consult with a local attorney experience in handling personal injury cases. Also, do not give Subway your evidence. The franchisee is probably hoping you get frustrated by the lack of communication and give up.
Without finding out what you potential legal options you cannot make any type of informed decision on how to proceed.
Good luck.
