Hidden Assets: How do I write a Motion for Creditors Bill in a child support case ?

I understand a Creditor's Bill is a lawsuit filed against the person who is in possession of the property I believed was transferred to. Is this action completely separate from the child support suit filed against the father. He claimed an income of 19K per year, but I believe it is really around 70K per year. I think she is holding his assets other than cash. Does this lawsuit require the whole kit-and-caboodle of discovery, depositions, interrogatories etc..etc..? Can I get all of her banking and credit card information as well? ---Child Support, Family Law, Motions, Proof---

I have never heard of the action you are talking about. You cannot sue someone in possession of property in a dissolution action. You do not state a lot of information and I would like to know: Is this an ongoing lawsuit? Is there some sort of action pending? Do you have an attorney? Are you trying to set child support or modify it or is there anything going on at all right now? If you are involved in an ongoing divorce you are allowed to take the deposition of someone with knowledge of the case and that would include employers or persons who have possession of property. If there is no action pending (the lawsuit is over and you are thinking about going back to court for child support modification) there are different rules. You would do well to have an attorney since it is pretty clear that you are in over your head and could likely fact a lot of monetary expense to adverse parties if you don't do things correctly.
