If you have contact with the mother and she is willing to sign an acknowledgment of paternity, you can file that with the state and get a amended birth certificate. If not the father needs to file a complaint to establish paternity and custody. Through this process, he can get legal custody and have his name put on the birth certificate. He may want to do this anyway to protect his rights in the long-run. You should speak with an attorney about your options. Alternatively, the two of you can file for guardianship of the child. In either case you will need to publish as to the mother if you do not know her whereabouts.
