Do I have a chance for dismissal of my speeding ticket?

The officer wrote my approximate speed at 80 mph and the max speed at 65 mph. The actual speed limit for the area is 70 mph. I got cited for CA VC 22356 (b) No person shall drive a vehicle upon that highway at a speed greater than 70 miles per hour, as posted.

Chances for dismissal include "officer does not show" , "challenge of basis of estimate", "radar device not calibrated and many more. 80 in a 70 is an offense, it computes a 10mph gap / 80 which might be a 12% difference, etc. Max speed may not seem to impact "notice and opportunity for a hearing".

You should fight this ticket with the help of an attorney . A demurrer should be filed as the code section cited was not violated. I did the same for a 100+ mph case. Officer wrote exactly 100 mph. Must Bevin excess of of 100 mph- case dismissed. Get an attorney . Andrew Roberts
