my husband and i are going through divorce proceedings he lives out of state and he received a check from the clinic due to an over payment the check is in his name only.can i sign his check since we are still legally married?

No, that is forgery and is illegal whether you are married or not.

Legally no- You would be forging his name.Forgery is a crime. It is not something you should do. However, with his consent in an emergency it can be explained.

Often the banks will stamp the back of the check and accept it without signature if it is going into a joint account.
