Am I responsible for Medical Bills?
Anonymous1 views2 answers
About two weeks ago I was watching a baseball game and some kids were hitting the baseball outside the fields, which were told to stop once by some other parents. They did not stop and the ball they hit, hit me in the head. I was taking to the er because I could not see out of my left eye. My vision came back but I ended up staying over night because they saw a spot on my brain that was bleeding (a subdermal hematoma) I have tried to contact the person over the Park and noone will call me back. So far the bills I have got through the mail is close to $6000.00 Is it something that I am responsible for? Or are the City Parks responsible?
Since you received the medical treatment, you will be responsible for the medical bill(s). However, you should consult with a personal injury in your area and have that attorney (1) check to see if the owner of the baseball field has "medical payments" coverage which generally pays medical expenses (up to a certain amount, if incurred within a given time after the injury), and/or (2) try to identify the kid(s) who struck the ball that hit you (and the other boy(s) playing with the batter) and file a claim with their parent(s)'s homeowners insurance carrier. As a last resort (and assuming that you don't have any health insurance), see if the hospital has a program (such as Hill-Burton monies) to pay (or write-off) your medical bills.

As I am licensed in Florida and Vermont, I cannot offer you specific advice as to your state law. However, generally, you in the first instance are responsible for paying your own medical bills. The children may be responsible for causing your injuries and if they breached a duty to you, they may be responsible for reimbursing you for your damages. If their parents carry homeowners insurance, they, in all likelihood, would be covered under their parents policy. From your question, it is difficult to see how the city breached any duty it owed to you, causing your injuries.
You should arrange a consultation with a local personal injury attorney and review the specific facts of your case with him or her. Identifying the children involved in causing your injuries would be very helpful to determining whether or not you may be able to recover for your damages.
