Can a business owner apply for L1-A visa ?

2 views 3 answers
I have a technology company based out of India and in business for the past 10 months with revenues over $400K and I see a great potential growing the business further by starting operations in USA. Most of our current revenues come from clients based in US. I am a majority equity holder in the business and I wish to build the US division there myself. Am I eligible to apply for an L1A visa? If so, should I be drawing salary from my current business in India? Although I am a stakeholder and working full-time for this company, I have not been drawing the salary so far. Thanks in advance for your quick response.

You will need to wait for the businss to have been going for at least a full twelve months, but you otherwise from what you have desribed an L-1A will be a good fit. The issue of compensation will need to be reviewed, but it is not critical that you are drawing a salary currently for your time with your company while in India. If I can be of further assistance please let me know.

It's difficult to determine your eligibility without additional details. If you are serious about expanding the business to the U.S., you should contact an experienced immigration attorney to assist you with the visa process. There are a number of visas that you may be eligible for (depending, of course, on additional details about your company, your role, and your goals for the expansion). You can contact me if you'd like a reference for an excellent immigration attorney in Seattle. It would be well worth your time to have a short discussion with her.

Yes, you can apply. You need to retain an experienced immigration lawyer, whether myself or one of my colleagues, to review all the facts, advise you, and handle the case.
