Its been 22 months since my slip & fall
Anonymous2 views4 answers
On 10/2010 i was 9 months pregnant. I went for a walk around the block. I didnt notice & slipped on mildewed wet sidewalk. My ankle broke completely & was dangling. My boyfriend who was with me at the time had ran to the house to get the car & ruched me to the hospital where i had xrays done. I broke my tibula & fibula(ankle) completely. They brought me into labor n delivery and i had to be induced & deliver my baby, then within 30 minutes i was wheeled into surgery where they put in a metal plate & screws.:(
1st priority was my health & the fact i had not recovered fully when i got pregnant again. Im not aware of my rights or how to pursue this. I can no longer run, i can no longer wear heels.
Im still in pain....
You might have a case against the landowner adjacent to the sidewalk, and possibly the city. The real issue will be the mildew. I hope that you got photos of the condition of the sidewalk. Talk to a good local PI lawyer. Sorry that happened to you, I hope your baby is okay! Good Luck….
I'm so sorry to hear about your fall and injuries. It sounds as though you may have a claim against the adjacent property owner. However, liability would depend on a number of factors. In order to sue a government entity you needed to file a government tort claim within 6 months of the date of the fall. You should hire an attorney who is experienced in handling personal injury claims. My office provides no cost consultations.

You should contact an experienced attorney in your area IMMEDIATELY to protect your rights. There are strict time lines for filing a claim or a lawsuit against the responsible parties. If you miss those time lines your right file a lawsuit may forever be lost.
Immediately consult a personal injury trial lawyer in the area where this happened. CA generally allows two years for personal injury limitations. It may be that your claim must be against a governmental entity, which would require notice be given within 6 months. You are are well outside that 6 month period, if the clam would be against a public entity, ask a California lawyer to evaluate your facts for "constructive notice." Do not delay. The legal consultation should be free. Check avvo and lawyers.com for a qualified trial lawyer in the jurisdiction where this happened. Good luck.
