Wording for appeal unemp denial Texas for Misconduct

Employment 2 views 1 answers
I was terminated per TWC for violation of copany rules and policies, considered as misconduct connected with the work. I made a common clerical error that is made almost on a daily basis at the worksite. A co-worker also terminated for the same incident. I don't feel that fair consideration was given to extenuating circumstances surrounding the occurrence. I also feel that discipline for this type of error is administered equally to all employees. I have an almost 25 year history with this company and was given an acceptable performance eval in Sept 2011. I did appeal the termination with the HR dept of the employer and it was upheld as final (details of the investigation did not exactly match the event). I am considering filing wrongful termination for age discrimation with EEOC. Thanks

Whether or not other employees were disciplined for the violation of company policy is immaterial to your appeal but you should list it anyway. No lawyer on this site can tell you how to word your appeal without a thorough knowledge of all the facts.
