Am I liable if my minor daughter gets into an accident while driving my ex wife's car, if my ex hasn't added her to the policy?

We live in Rhode Island. We have joint custody. My ex has had issues keeping current with only herself on the policy and I doubt she can afford the increase in premiums. I do not think this will stop her from letting our daughter drive her car. If there is an accident can I be held liable or sued. thank you,

If you are a registered owner on the vehicle then, potentially, yes. Your daughter should not be driving without insurance coverage. Consult an attorney in RI to know for sure.

Unless you are an owner of the vehicle your daughter is driving, there is little likelihood that you would be found otherwise responsible. Why couldn't you add your daughter to your automobile liability insurance policy and that way you can make sure that there is coverage for her. With joint custody, many times a child will be deemed to be a resident of both the mother and the father's home. Discuss these coverage issues with your insurance agent. You also should speak with your daughter and impress upon her the need to make sure that she is a covered person. If you don't put your daughter on your policy, perhaps you can assist your daughter in paying for coverage on her mother's policy. Under no circumstances should you allow your daughter to drive while she is uninsured, as a significant judgment against her could force her into early bankruptcy.
