Hi I am currently on L2 and my L2 extension papers are pending with USCIS. Meanwhile my H1 has been aproved and would be ineffect from October 1st, 2008. Now assumimng that my L2 extension aproved on Otcober 10th.. I would be back to my L2 status. 1. At this point can I apply for the change of status from L2 to H1? 2. IF yes, how many day it would take me to do it?

Based on your fact pattern, you do not indicate which status on which you desire to proceed. If you want to be on H-1B status, you need to withdraw the L-2 extension. If you want to proceed on L-2 status and need a gap fix, use the H-1B for those days between the expiration of your current L-2 and the grant of the extension. We cannot predict processing times for cases. Processing times are within the purview of USCIS unless you pay for premium processing; $1,000.00 for an answer within 15 days.
