AAfter 27 years my husband packed and left. I had a home from my first marriage which we put up for collateral for getting a mortage for marital home which we built. Now husband says I can have martial and my original property which now all has a mortage on of 160000.00 on it. He will take the property we also have that has no mortage on it free and clear. That is his offer. Can I be force to setttle for this for I do not think it is a fair settlement for I will owe 106000.00 and he will owe nothing.I I am 12 yyears older than him and has since retired after his leaving 7 years ago and still not no settlement. MY property before marriage to him had no mortage/

A settlement is when both sides agree. No one can force youbtobtake a settlement however they may highly recommend it. When considering a settlement it may be helpful to speak to an attorney to discuss what all your options are what the likelihood of success at trial would be as well as costs. I hate to say it but often the costs drive decisions. It is not something I like because I hate people choosing something that is not recommended simply because they don't want to incur any further costs. That being said a settlement is the only way you can guarantee an outcome. Sitting down with your attor ey to discuss all options is worth a try. I wish you the best of luck now and I the future.

This is a duplicate post. You do not have to sign a property settlement agreement unless you agree to the terms proposed. You can always counter the proposal or just flat out reject it. It's likely that you should seek counsel to help you in resolving this matter.

This is the same questions listed in a different posting -- if its the same person asking, the answer is the same. No, you do not have to sign any agreement you do not want to sign. Any settlement, by definition, requires the agreement of both sides/parties. If you and your husband do not agree on the division of property, eventually an equitable distribution hearing and/or trial will be held, and the court will determine how property will be divided. You should consult a family attorney immediately to review your situation in more detail and protect your rights.
