I know a girl who is 16 and for a year has been with a 21 year old, he was 19 when they got together and she was 15, he lives in another state, but is moving back down to Nevada, is it illegal for them to have sexual relationship, and a relationship, or does it have to have parental consent? I need an honest 100% answer ASAP.

The age of consent in Nevada is 16, so yes that relationship is legal. What is YOUR interest in the relatonship? Parental consent is never a factor in a sexual relationship where age of consent is a factor. Needed at certain ages for marriage, of course.

So long as the 16 year old remains in Nevada and the 21 year old comes to Nevada, the 16 year old may consent to sexual relations with the 21 year old. If the 16 year old leaves Nevada to any other state and has sexual relations with the 21 year old, the 21 year old would be subject to federal laws prohibiting sexual relations with a person under 18 years old. This would be the case even if the other state had an age of consent of 16 years old. Crossing state lines invokes federal jurisdiction, which is different than state law.

Pursuant to NRS 200.364(5) the age of consent is 16 years old in Nevada. Accordingly, sexual conduct between the parties presently is legal. However, when the male was 19 and the female was 15 sexual conduct between the two constituted statutory sexual seduction (commonly known as statutory rape in most states). Statutory sexual seduction by someone under the age of 21 is a gross misdemeanor pursuant to NRS 200.368(2). A gross misdemeanor carries a maximum penalty of a year in jail and a $2,000 fine. Additionally, statutory sexual seduction is considered a "sex offense" pursuant to NRS 179D.097(c). This means that, if prosecuted and convicted, the male would have to register as a sex offender.
