Amending a traffic citation?

I am being charged with 22450(A), if this is a point on my record, how would I make the pitch to the officer to amend to a non point infraction. What would I say? And is there another code to do this?

Yes it is a point . Get an attorney to attempt to make a plea . He gave you the ticket - not the attorney . Andrew Roberts (818) 597-0633

This response is not intended to create an attorney-client relationship. The information offered in this response is for general informational purposes and is not a legal consultation. You must talk with an attorney of your choice before making any decision about your actual legal rights. VC 22450(a) is a point on your record. If you are eligible for traffic school (have not been to traffic school in the last 18 months or have no points placed on your driving record over the last 18 months), go to traffic school and drive carefully for the next 18 months. If traffic school is not available to you, you can always ask for Level 2 traffic school to prevent a point on your license, but your car insurance may still increase. The citing officer can always amend the cited charge on the ticket and/or dismiss it if he or she wants to. Rarely in the cases I handle is an officer willing to do either one of those options. It never hurts to ask, but your best chances of getting a great result is to hire a local attorney who knows the courthouse and may already have prior dealings with the officer in your case.

You can always try talking to the citing officer at the time of trial to see what kind of a deal can be worked out. As was mentioned, sometimes they agree to a deal, other times they do not. It will depend partly on whether you were cooperative and nice at the time they stopped you. It is usually best to have an attorney talk to the officer on your behalf, but if you are game to do it yourself you could try asking the officer to amend the charge to a violation of vehicle code section 38300, which does not count as a point on your record.

I concur with my colleague. At the hearing, ask the Officer if he would amend the Citation to one who carries no points. Good luck to you.
