i went to this ladys house where my disabled brother was spending a lot of time to confront her about an issue. Apparently she has been telling my brother he needs to move into her house and put his ssi check in her name. so i went down there to let her know that there is NO WAY that is happening. i got there she wouldnt let my brother out the house so i called the police. they arrived & told me because i do not have power of attorney over him there nothing they can do & that i would have to leave & if i came back i would be arressted. i told the officers thank u & they left while i was still there & then i went home. 20 mins later i walk outside with my husband to tell him bye before he leave for work & here come the cop pointing a gun at my hubby & then arresst me for criminal tresspass

The worst that can happen is that you are sent to jail for 12 months, assuming that you are only charged with one count of criminal trespass. While that is an unlikely sentence, based on your post you should hire an experienced lawyer immediately.

I strongly suggest you speak to an experienced criminal defense attorney as soon as possible. Based on your question, you may have defenses, or at a miminum a sympathetic set of facts, to the charge(s) against you. It is important to have a strong advocate who will help you navigate the process and present your case in its best light. Also, please consider that the judge will likely not be patient with anyone showing up in court to ask that this matter be continued to get an attorney after years of these charges having been pending, even though the years-long delay may have had nothing to do with you.

You face a possible year in jail and $1000 fine, plus surcharges, and a criminal record for life. Your sentence or outcome could possibly be less, but do you want to chance that? You should have hired a lawyer when you are arrested. You would frankly be a fool to show up in court without legal counsel. A lawyer will assist you with defenses (and, if needed, sentencing).
