I bought a car on 7/16/12 and told the dealer I was late on my mortgage by 1 month they said no prob. Signed papers they took my trade and then on 8/8 called to say financing fell through and they sold my car. We were about to do a loan mod on mortgage but delayed because They offered to pay 1/2 my deliquient mortage( 2000$) from what they earned of selling my car but gave the check too late( 16 days later) and now my house is in foreclosure and I can't get approved. They offered an outragous deal at 25% apr and we declined and said we will give the new vehicle PLUS their 2000$ back if they will just give our car back. ( which they now as of today mysteriously have back They want us to pay 51 cents per mile on the car we are returning which is around 1100 dollars we went on a family trip

You are in the middle of a yo-yo deal. The dealer financed the deal on paper. The dealer put you in the car thinking he was going to be able to sell the paper to a lending institution. You think you are financed. That takes you out of the market while the dealer shops the paper. When the deal falls through, the dealer is required to put you back in the position you were in before the deal. That means you should get your car back. I expect the dealer had you sign a document saying if it could not sell the paper you had to bring the car back. It sounds like it even says if the deal does not go through, you will pay mileage for the car. This transaction is very complicated and involves federal and state laws. You need to find a consumer lawyer in your area to help you. Try looking here: www.naca.net or http://www.ohiolemonlaw.com/locate-a-local-attorney.shtml Good luck.

Boiling it down, if the agreement does not call for this charge, they can only "ask" for it not require it. I recently had a dealer demand it from a separate document which was a violation as that other doc was not referred to in the underlying sales doc. That's CA law though. No idea if this flies in UT. You should try looking here: www.naca.net for an atty to help.

It sounds like you are getting ripped off. Check your sales paperwork carefully and argue with the dealer and if it doesn't get worked out then call Jon Rogers or James Taylor. They are both Utah lawyers and their contact info is at www.USLemonLawyers.com. They know car sales fraud law and can help you out.
