If you did not pay the attorney any money, then everything is fine. You were correct in writing the attorney a letter to cancel his/her services. Ask for a refund of all unearned fees. Do your homework before hiring your next lawyer.

You should review the representation agreement, especially as to any provision as to termination of services. Even if the fees are earned according to the agreement, the attorney may decide to return all, because if you do file bankruptcy, such fees are reportable in the schedules. The attorney may be required to prove he contributed valuable services toward your case, or the bankruptcy court has the authority to require disgorgement of any retained fees. You would be better advised to research, before you retain professional services.

Send a written disengagement (termination) letter to fire the lawyer and then find one you are comfortable with. You should only use a lawyer you trust to act in your best interest and with won you are comfortable. There are enough great lawyers out there that you do not have to stick with one you don't trust.

Most attorneys contracts that you sign who file bankruptcy for clients have a provision in the contract refunding any unearned fees pro rata for the work they did. For example if the are disengaged in writing and you paid them money they are required to do an accounting of any money paid and issue a refund if one is due to the client. The question would be how much you paid them and what work did they do? You did the right thing sending a written letter to them disengaging them. When hiring a bankruptcy attorney or any attorney certainly do your research and read the contract before signing it. With all my clients I go through the details of the contract as well as the process of filing. I try to have no unhappy clients if possible, and reviews on this site as well as my website. Most good bankruptcy attorneys will have reviews or testimonials out there.
