What do I answer when asked if I have ever been convicted of or pleaded no contest to a crime in Phila, Pa on a job application?

I am on probation for a DUI in Phila, Pa. I'm in the ARD program and from what I understand this is not a conviction but I'm guessing it will show up on the background check. Btw I thought it wasn't legal to ask this in Philly on job apps but I guess its a job to work with Children so that matters, but I just want to know if I should disclose the arrest and probation on the application. I am willing to do so in person but I don't want to seem as a liar since I already didn't mention it on the application...
If the question is whether you have pled "no contest," check with a local employment lawyer on whether that is a permissible question and if not what you should do.
Generally a lie in response to a question on an employment application is grounds for discipline, including firing. I do not know that this is the case where you are working, though, for this question.
If you had an Attorney who represented you throughout this case and throughout ARD, it is best that you contact them with your question regarding the job application.
When one of my clients has a situation such as this, I always ask that they send me a copy of the job application so that I am able to review it myself and provide them my suggestions as to how they should answer.
It is always best that questions such as these are directed to the Attorney who handled your case since they would best know the outcome.
There's a big difference between no contest and ARD. Make sure you know which one. If it's ARD and you finish the terms and conditions, then you should be able to go for an expungement. You can then check now on the Job Apps. This is a question you should ask your lawyer.
