Can I start a non-profit organization when I am in my H4 visa?

This is Nancy. I am in my H4 visa. I have a real passion for cooking. Can I start a non-profit organization (a home based hotel, where we cook and supply food in a daily basis) and employ a chef or two, and use the money that I get in just paying the cooks and later on developing my home based hotel into a real restaurant. I have absolutely no idea about the same.. I will be really really thankful for your help.

Whether the enterprise is a profit-making business or a non-profit service may not be central to the case. What may be important is whether you can employ the cooks and whether having a restaurant in your home is consistent with the zoning laws of Charlotte. I'd consult with an Immigration Attorney nearby on the H4 visa issue and the business, and I'd also have the attorney look into whether or not there are local business zoning and licensing requirements as to the restaurant. Good Luck !!

An Immigration attorney can certainly point you in the right direction. Good luck!

You cannot work, whether paid or unpaid, while on H-4.

The issue is what is the activity you are doing in the US. Any productive employment whether it is for profit, paid or unpaid requires a valid US employment visa in order to work in the US. Maybe you should consider an E-2 Treaty investor visa if you are a national of a country that has an E-2 treaty with the US. Best of luck!
