Workers compensation statutes require that the employer and its insurer pay benefits in accordance with the law and not what the employer and insurer unilaterally proclaim. The key here is whether you were "in the course of employment" and whether on or off the clock is a factor but not necessarily the final determiner. Many many more facts are required. Your injury MAY be compensable but MANY more details are needed to render any opinion. Meet with a local WC attorney to discuss.

A worker who sustains injury "in the course and scope of employment" is entitled to worker's compensation benefits. Whether you were punched out or not is among the circumstances that are considered in deciding whether the injury was sustained in the course and scope of employment, but it is by no means the only factor nor the controlling one. Consult a lawyer licensed in Vermont who handles personal injury and worker's compensation claims for an in-person consultation to assist you in evaluating your legal options. Not legal advice as you and I don't have a confidential attorney-client relationship. However, I handle matters in Rutland and Addison counties. Feel free to contact me.

You should obtain needed medical care and treatment immediately and follow the doctor's advice. Do not give any statement to the adverse party or insurance company nor grant them access to any medical records. Photograph the injuries and the damage done to any property. Contact a personal injury/workers compensation attorney in your area as soon as possible so that you can protect your rights.
