Will an expungement for a petty theft infraction cause an employer to reconsider?

I'm confused about my situation. I was recently offered a full time position after interning and freelancing at a company for 3 months, only to be disqualified for my petty theft infraction almost 10 years ago when I was 19. They have a zero tolerance policy. My direct manager is really pushing for me because I'm regarded as a great worker, and wants me to get it "erased" or expunged, then she said they could hire me. How is that, if the company is already aware of my infraction? Is that possible and how can that make sense

Yes, it is possible. An expungement effectively seals your record from private employers (but not governmental employers or licensing authorities) and allows you to truthfully state you have no conviction. The motion asks the court to permit you to withdraw your plea. The court then dismisses the case. Once completed, your company can no longer use the conviction as a reason for denying you employment. You can expunge an infraction. This should help you with the situation. However depending on what courthouse your conviction is out of this can take 4-6 weeks. If you want assistance contact my office directly at 949-660-1389.

My colleagues are incorrect insomuch as 1203.4 requires dismissal. 1203.4(b) specifically says this code section does not apply to infractions, which unfortunately you pled to. You will have to petition the court to dismiss your infraction in the interest of justice. You will need an attorney for that. Good luck.
