I have a restricted license right now and have not went to court but I know I will be convicted once I go to court. I share a car with a relative so was wondering for my second dui 6 years apart is there a possible way I could avoid getting and interlock. Do they just require those for 3 or more?
It will be up to the Judge who decides your case whether he/she will order interlock. There are many things you can do pretrial to help try an convince a Judge interlock is not necessary, but it is certainly within the Judge's discretion and within the realm of possibility on a second offense.
Is it possible, yes. Having a good DUI/DWI lawyer will make it more likely if you can't completely beat the charge. Getting an alcohol assessment and beginning treatment would likely help.
If you are convicted of either alcohol-related offense, you will receive either eight – 12 points on your drivers license.
This will cause the motor vehicle administration to issue either a notice of suspension or revocation. However, if you are currently enrolled in the ignition interlock program, the motor vehicle administration will give you an option to continue your participation in the interlock program with the restricted license for an additional 12 months in order to avoid the suspension/revocation.
In addition to this, the judge may impose the interlock as a condition of your probation. This could result in up to three years in the interlock program. However, the interlock condition is not a standard condition, and the most that I've ever seen a judge impose is 12 months, unless you have had several prior offenses.
