Health Insurance Premiums. Who pays?

Business 3 views 3 answers
My ex is remarried, and he covers my daughter's health insurance through his employer. He also covers his new wife and her child (from a previous marriage). Currently, I pay him 50% of the difference between a single plan/family plan, so in effect...I am paying for his new wife/child's coverage. Because he is remarried, he would have to have a family plan anyways. Should I be liable for this expense?

My experience as a New York child support attorney suggests that if the remarriage occurred after the agreement/order for you to pay 50%, then you can and should seek a downward modification to a proportional share of the premium costs. If there are additional pertinent facts, you should consult with a local attorney for further assistance and to help you file your petition for a downward modification. As the prior attorneys indicated you do have a change of circumstances to request a reveiw of the health insurance coverage. You would need to file a petition for a modification of the payment. See a local attorney to discuss the matter in detail as there may be aspects of your agreement that you did not mention. Based on the facts you have presented it would appear there has been a change in circumstances that would warrant a downward modification from your present order. I would recommend consulting with local counsel to discuss all your options to this end. Best of luck to you.
