For about 6 to 8 months I have been telling John the president on the HOA that I’ve been having water pressure problems and that I’ve been seeing dirt in the line at the faucets and shower heads. He had a plumber come out and change the main water shut off valve in front on the unit. On August 20, 2012 I call John to inform him that the main breaker on the house was tripping and that the electrical panel inside the house was heating up. August 21, 2012 I texted John to see if he had heard anything about the electrician and when he would be out to check the panel. On August 23, 2012 I call and text John because I didn’t have any water pressure upstairs and notice that the water heater sounded like water was running. He told me to shut off the water valve to the hot water tank. On August

The answer to your question depends on whether the broken pipes are inside or outside of the parametric boundaries of your condominium unit. You can determine this by reading the declaration of condominium. Most condominium units do not extend below the slab. If the pipes were outside of your unit, they are common areas of the condominium and the association would have the responsibility to repair the pipes and pay for any damage caused by the leaking water. If you are unsure of your rights as a condominium owner, you should consult an experienced real estate lawyer in your area.

If the pipe burst in an area that you own, you are likely responsible for the damage. If the pipe broke in an area that is owned by the Association such as common areas, they may be liable for the damages ou sustained. You would need to establish that the Association has the maintenance responsibility of the pipe in the area where the leak occured and that they failed to properly maintain the pipe. The issues are many and may be complex.
