Neg 1 and flying into Canada

2 views 4 answers
I received a Negligent driving (Neg 1) a couple years ago (2). Now I have an important business trip coming up that will involve flying into Canada. I don't want any issues because I will be traveling on the company jet with the owners. Is there anything I can do to make sure there are no problems? I will not be driving into or in Canada. I have herd that if you are not driving in Canada you will not have the associated problems Is this true? Can I fly in with a passport and be ok?

A Neg 1 disposition will not prevent you from entering Canada (unlike a dui).

Sorry to disagree with Mr. Kaman. A Negligent Driving First Degree conviction under WA state law involves driving and alcohol, and Canada prohibits entry for those convicted (and often, those merely charged) of such offenses. It may well be that flying in, rather than driving, would be less likely to lead to discovery of your criminal history, but that is not something one would be prudent to rely upon. The Canadian government has a process whereby one can petition to enter. I understand this can take several months lead time to get approval. I've added some links where you can read about this yourself.

Ms. Callahan is correct. I have had several clients denied entry into Canada on the basis of a conviction for Negligent Driving in the 1st Degree. The Canadian consulate in Seattle has a webpage identifying who is inadmissible to enter Canada along with instructions what one needs to do to get in with prior convictions. I'm not sure if any has posted this but here it is for anyone who needs it. http://www.dfait-maeci.gc.ca/can-am/seattle/visas/inadmissible-en.asp

The simpliest answer is that it will be a discretionary decision by the border agent. Although a Neg 1 doesn't specifcally prevent your entry into Canada, it would be up to the individual agent to make the decision regarding entry. Just keep in mind, you could be denied entry, so make plans ahead of time in case that happens.
