DUI and Deferred Action? Immigration.

My Boyfriend got a DUI charge in 2005. He showed a fake mexican license which said he was over 18. He was actually 17 at the time. He wasn't got driving at the time. He crashed his car into a ditch, and walked home. Is there any hope in post conviction relief? Can we get this reduced to a juvenile DUI? Would reducing this to a juvenile charge give him a shot @ deferred action? He qualifies in every aspect except for the dui.

A DUI is an automatic disqualifier for DACA.

Both of my colleagues are correct. Under the current DACA guidance, a DUI is considered a significant misdemeanor. Unfortunately, it will disqualify him from receiving deferred action.
