I was arrested for aggravated DUI 4 mos ago due to having a minor in the car but my initial court appearance was scratched. I was told prosecutor is probably waiting for blood results even though breath was done. How long does it usually take to get blood test results from DPS and for prosecutor to bring charges?

Blood test results for alcohol usually come back relatively quickly, those for drugs take more sophisticated testing and can take longer. Here in Wisconsin it is usual to have to wait 6 months or more. In the meantime, you should have your own DUI/DWI attorney to be asking these questions. You want to have someone ready to jump in, otherwise you give the preparation and timing advantage to the prosecution. That lawyer can help in preserving crucial evidence of your innocence. The field sobriety "tests" are designed so that sober people will fail them, even if they are properly done. Often, they are not properly done. Only someone with expertise in this area can recognize problems with how the tests were done. http://addbalance.com/fieldsobrietytests.htm What to do if you are stopped when you have been drinking? http://addbalance.com/duistop.htm

DPS can take a few months to get the blood tested. However, the state has 7 years to charge you with a felony. Aaron M.
