My wife had a DUI in a town 135 miles from here, and is required to see a probation officer there.

I am away at work a lot, and she has no drivers license. She can't get there when he wants her there. Can't they have an Id. state probation officer closer take care of this ?

First I would direct her to contact her current probation officer to explain the situation to see if they have a remedy. Many times when a person commits a crime in one jurisdiction but lives far away from there they will allow that person to do mail in probation. If the problem cannot be solved through the probation department it may require a lawyer representing your wife to present a motion to the court to explain the circumstances to see if alternative arrangements could be made.

In addition to what the previous attorney suggested, you may ask the probation officer about an interstate compact. This is assuming that her probation is from another state. Sometimes other states will just accept the probationer as a probationer in Idaho.

Sorry to hear this is such a hassle. I see you live in Kooskia, so I am not sure why the nearest PO is 135 miles away, but if that is the case, there may not be much you can do. The fact that she has to see a PO likely means this was a second DUI (misdemeanor) or perhaps a felony DUI. The inability to get to the PO likely means that her privileges were suspended for a year or more. With those facts, the other lawyers' suggestions make sense - namely start with the PO and explain the situation. If he/she won't fix it, you may be able to go into court to modify the conditions, but it seems likely that you will have to arrange a way for her to get to see the PO when he wants to see her. Probation is an opportunity to avoid more difficult confinement. Try to work this out.
