How do I get chexsystems to remove debt discharged in Chap 7 Bankruptcy?

2 views 3 answers
I filed BK Chap 7 in Dec 2010 and was Discharged in April 2011, everything has been taken care of on my credit report however ChexSystems still show I have two outstanding bank accounts which I do not have because they were discharged in the BK. I contacted the Banks and they tell me nothing they can do because ChexSystems will not allow them to remove it unless I pay it. I am not going to pay it because it was discharged in my BK.... I tried to contact ChexSystems and they will never get back to me and I cannot get this removed. Please HELP!

It's an interesting question. I probably would agree it's a violation of the discharge injunction for them not to remove it.....after all, what is the point than to collect on a debt? I don't know if there has been litigation on this, but if there hasn't, maybe there should be.

If you send Chexsystems your bankruptcy case information and your discharge they should update your file. You can find a form to dispute information on their website along with their customer service contact info and their mailing address. Good luck.

Chexsystems is similar to a credit reporting agency, they are reporting factual information about a overdrawn bank account. Chexsystems is not a creditor; they are not forcing you to pay the debt and aren't attempting to collect the debt. Chexsystems is only reporting the information to banks to let banks decide if they want to allow you to open a bank account with that bank. I disagree with my colleagues, I don't see this as a violation nor do I think sending a copy of your discharge will result in them not reporting the data.
