Their Collision and Uninsured Motorist Coverage, should cover them. The insurance company has the option to file a lawsuit and try to collect what they paid back from you. You may also be charged in criminal court . Thep person you hit will be able to collect their out of pocket expenses from you, the criminal defendant. You will be put on probation in most instances if this is your first offense and will be ordered to pay any out of pocket expenses that they have as restitution. Under most circumstances this is the deductible on their Collision insurance.

Bottom line, if the accident was your fault then you have to pay the damages. This is why you always need insurance when you have a car.

Maybe -- what you need to hope for is that the other person was not hurt as personal injury cases can cost real dollars. If the other person had insurance, you also need to hope they had uninsured motorist coverage, which may compenstat them for the property damage and the personal injury claim they make (if injured). Then, the carrier may indeed seek re-payment from you. If that happens, you may want to hire an attorney that works in the area of insurance defense to fight. Good luck!

No fault is a misnomer. No fault means that each insurance company pays for a certain amount of medical bills and lost wages for its insured. They still have the right of recovery from the "at-fault" party. That recovery may be for any medical expenses over the first $1,000, as well as damage to the vehicle, as well as pain and suffering for any one who may be injured.
