I think my former employer may be in violation of COBRA law. I have been enrolled in their COBRA insurance since Dec. 2011.

The group health plan was changed as of 8/1/12, but the employer has failed to provide the rate information to the COBRA administrator, and I have been unable to get the premium payment amount and payment coupons. I have contacted the employer twice but they have not responded. The COBRA administrator says I will not be terminated from the policy, but I am not comfortable with the fact that I haven't made a payment since mid-July. I am a cancer survivor and I know that my participation in this small group plan is causing their insurance cost to be high. Since I don't get a response from the HR dept., I am wondering if there may be an effort to set me up for cancellation. I want to file a complaint with an agency before it gets to that point.

Private Companies are regulated by the United States Department of Labor. More specifically, the Subdivision known as the Employee Benefits Security Administration ("EBSA"). EBSA Investigators detect and correct violations of Title I of ERISA (the group health insurance regulations). The EBSA has an active investigative staff in field offices in every state. You can call them on the toll-free hot line: 1.866.444.EBSA (3272). I wish you the best of luck.

Have you communicated with the employer or COBRA administrator in writing, sent by a provable method of delivery such as certified U.S. mail, FedEx, or registered rPost.com email? Get some proof of what you were told by the administrator IN WRITING.
