You can get divorced in Texas if you have lived here for more than six months, no matter where you were married and no matter where she lives now. You can get divorced without her signature, but you will need to accomplish legally sufficient notice to her. Since she's not in Texas, and may not be cooperative, it would probably be beneficial to you to have an attorney help you. You should not be liable for her surgery; you separated long ago, and generally each party is responsible for any liability created by that party after separation.

If Texas is the last state in which you and she lived, go ahead and get a lawyer. File suit for divorce. With her in another state, it might be easier for you to use a professional to handle the matter. I suggest contacting an experienced family law specialist to handle this for you.

My office is located in Rowlett, Texas. Give me a call and we can discuss your situation specifically. I do agree with the others that have answered your question. The cost depends on several different factors.
