How can I terminate probation early in Passaic County NJ?

I was sentenced to 5 years of probation in October 2011 for fraudulent use of a credit card and have currently completed nearly a year. I never had a record prior to this and will never get into any trouble ever again. I have paid all fines, completed community service, etc. I have a great rapport with my PO, but reporting monthly is an issue with my job (9-5) and have to leave work early every month to report. In addition, I currently work in IT as a contractor and am trying to get my record expunged ASAP so as not to interfere with future employment opportunities. The conviction is in B ergen County but I live in Passaic County (where my probation was transferred to). Is it possible to get probation terminated prior to the 50% mark? Does this get filed in the county of conviction?

Make a motion before the sentencing Judge. Have the PO write a letter in support. This is best presented by an experienced criminal defenase attorney. Call your previous attorney who knows the case best.

I agree with Mr. Cheser. Why didn't you get into pretrial intervention? Discuss this with your lawyer. Perhaps if it was not considered you can file for joint reconsideration of sentence and convince prosecutor to consent your case into pti retroactively. If not, then get involved in long term community activities so you can qualify for a five year expungement.

The law that applies to probation actually says that you can be discharged from probation at any time after being sentenced to it. The 50% mark is arbitrary. This can be at the request of the defendant, the court, probation, or the state. You may be able to just as your PO. As a matter of policy, they may not do it until at least half of the time has elapsed. But even if they say no, you can still put in a set of motion papers laying out all the reasons why you should be terminated from probation early.
