Am I eligible for Unemployment if my employer terminated me prior to settling W/C case?
I'm considering a W/C settlement offer. Former employer claimed I was laid off but they actually terminated me, discovered only after my 401k administrator notified me I was ineligible to roll into a private IRA by missing the 90 day window. The IRS agreed with me and waived the 90 day rule so I don't need to resign as I have already been terminated.
After an IME the carrier has accepted full responsibility for both wages and medical. They have not reinstated my weekly indemnity benefit because I am already collecting U/C and they are offering to settle. Although I am unable to do the job I held, I continue to be able and willing to work. Can the carrier still insist on a resignation thus disqualifying me to collect? I am aware of the ruling No. 2085 C.D. 2010, but does that apply?
