My punishment was 36 months of provation and pay a fine. The fine was paid at the time of sentensing and I'm 11 months away of finishing my provation .

Well, you have completed all your terms of probation except for the time on probation. Judges are reluctant to terminate probation early unless there is an underlying circumstance that makes being on probation hard. Can't find a job, ect. However, with the right attorney, you could convince the City Attorney to not press as hard. You should consult with an attorney. I am available for any questions you may have. From the way I read your question, you pleaded no contest to DUI 2 years ago? You do need to understand that if you get your DUI "expunged" under Penal Code 1203.4 it still counts as a prior DUI if you pick up another DUI within 10 years of the first one. A 1203.4 expungment also has no effect on any suspension of your privilege to drive, etc. I doubt it will take the points off your driving record, either. You might want to contact your car insurance agent to see whether the expungment would help your insurance rates.

Have you already filed the paperwork and had the City Attorney oppose the early termination of probation? Did you file a formal motion or just orally request it? What are your reasons for want to terminate probation early? Do you have grounds-such as it causing you problems in seeking employment?
