2 months ago I found out that the people I was renting from were being evicted,I found out when marshall papers came in the mail,I put in a order to show cause and was given a court date to come back,at the court date I show proof that I was paying the couple rent for a room and that I've been living there for a year,I asked the judge to give me time to move, because I did not know the couple owed money to the landlord, the judge denied me and gave me no time,The marshall papers were resubmitted and I recieved them last week,I came today and put in another to show cause to try to get until the first of october when I can move into my new apartment,I got the same judge as last time and she denied my to show cause, didn't even give me another date to come back,& the marshal is coming tomorrow.
Dear the marshal is coming tomorrow:
Do not waste time now trying to work around the reality that the eviction is of the non rent paying tenants, and all persons living in the apartment with them. You did not have an independent relation with the landlord and your remaining in possession would thwart the landlord's judgment to recover the apartment and to execute the warrant against the defaulted tenants.
Your focus is making sure that when the marshal comes, you have all your possessions packed and ready to go. The marshal will give little or no time to start packing, so get it all done tonight. Do not leave anything behind, because you will not get it back.
If the marshal changes locks and movers come to remove the property, the marshal makes one inventory list for the warehouse and the warehouse will not give you the right to get anything on the inventory list and at the warehouse, because you are not the tenant.
You will always get the same judge in an assigned Housing Court case, because the case sticks to the judge.
Good luck.
