Can I postpone a pretrial settlement conference and trial in order to get more time to save money for an attorney?

Child Custody 3 views 1 answers
I currently have full custody of my 2 kids after CPS took them away from their mother (drug use/shady characters). We have the settlement conference on the 10/9 and trial 10/19. I spoke to an attorney and need $2000 upfront to have him begin work. I will be coming into a large sum of money within a month but have no way of accessing it in time. I didn't realize I'd have to subpoena the court medation report/CPS reports/school records etc. Their mother has family connections for a local law school and its likely she'll be represented. I desperately need help and don't want to see my kids go through any more than they already have. Can someone please, please help me?

It is unlikely, but possible. An application to continue a trial is made pursuant to California Rules of Court upon a showing of good cause and in the interest of justice. You will need to attach a declaration to your motion in which you explain why you are trying to continue the trial at the last minute. You will need to make this an ex parte motion to make certain it is heard prior to the trial date. Also, you should contact the mother and see if she is willing to stipulate to a continuance. Good luck!
