Can I get expungement ?
Anonymous3 views2 answers
In 2002 I was arrested for soliciting along with approximately 8 other males, It was a local sting by the cops. I only asked an woman who looked very out of character for that area if she needed a ride. I went to court 3 wks later to plee my case but there was no record of me of my court date. I assumed they knew they got an innocent man, wrong place, wrong time. in 09 I found out there was a warrant, I went to court and pled no contest. I asked the court records clerk about expungement, he said I must wait 5 years from plee date. I went to court house and viewed charges, there are no details at all, just reads soliciting. since it has been 7 years since the alledged offense is it possible to apply for expungement? I cannot get a job with this alledged offense on my record
In most expungement statutes, the so-called waiting period runs from the date the sentence is completed, not from the date of the incident. Either check out the avaialable information on listings like http://lawdigest.uslegal.com/expungement-of-criminal-records/general/6510/ or contact an experienced criminal defense lawyer admitted to practice law in MI and ask for a consultation on this issue. Good luck.

Assuming this is your only conviction ever for anything, the clerk was correct. You have to wait 5 years from the sentence, not the offense. Why did you plea guilty in 09, when you could have had it taken under advisement by the Court? www.kliszlaw.com Tim Klisz
