If you are a joint debtor on a debt account with your Husband, then you are liable for the debt even if he dies.

A prenuptial agreement is a contract related to resolution of issues in the event of a divorce. It does not cover issues related to death. that is outside of its scope. Moreover, a creditor has a contract with a debtor that cannot be modified by any agreement they are not party to. As a result, if your name is listed on the det, you are responsible for it. If it is not, you will not be liable, but your spouse's estate may be.

Debt is generally a result of a contract between the creditor and debtor. If you signed any agreements to be a debtor or are otherwise able to be pulled into it because you are married, then you are on the hook, regardless of any prenup. A family law attorney will be able to help you figure out what your situation is legally and whether and to what extent you're vulnerable.

In addition to the posted answers-you can modify your agreement as a post-marital to deal with the debt issue.
