About 4 to 5 years ago i was arrested for being a accomplice to someone who stole some merchandise. when they told me what to plead the store gave them a huge list of items that was never found on the girl or the accomplice. she never kept her court dates or her community service. I did my community service and asked for an expungement, recentlly i tryed to enroll in a private nursing school and they said if i have a 484 (Theft- grand theft) i can not attend. i called the courts they told me i have a 484A which is petty theft. Can i get this sealed and dismissed and will i be able to get my license or attend school period.

You should consult an attorney. You can apply to the court to get a misdemeanor dismissed pursuant to Penal Code section 1203.4. There are some limitations on the effect of this dismissal, but it will help. Under certain circumstances (and I do not know if they apply here) you can apply to get records sealed. What the other person did with their case is not particularly relevant to your situation.

You said you tried to get an expungement, but you did not tell us whether it was granted. Unless you were a juvenile at the time, you can not get it sealed. An expungement is your only remedy. The nursing school, since it is private, can refuse you admission based on your background. Whether you can get your nursing license (assuming you go to a school that wil accept you): A conviction for a charge is not an automatic exclusion from granting your a license. The licensing agency will look to see whether the conduct and the conviction are relevant to your competent practice of nursing. You could attempt to demonstrate to the licensing agency your rehabilitation. Don't turn your back on your goal of nursing because you believe that conviction will prevent you from realizing it. Good luck

you need to file a motion to set aside the plea and expungement under P.C 1203.4. Also consult a criminal defense attorney to see if there are any other grounds to even vacate the plea. As to licensing there are various factors considered and you must consult a licensing attorney for clear answers on this area.
