Where can I hire a contingency lawyer to take over my divorce case?
Anonymous4 views3 answers
My spouse breached our private separation agreement after I filed for divorce.
She was helping me since I was out of a job. She got impatient and suddenly, without notice, took the marital assets and marital estate, forcing me to be homeless.
I need help -- my final hearing is set for December 2012.
Contingency fees (typically a percentage of an available sum, as in retroactive benefits, judgment, or damages settlement) are commonly used in certain types of cases, such as personal injury, workers' compensation, and Social Security disability.
Contingency fees in family law, however, are considered in most states to be per se unethical.
Best wishes for an outcome you can accept.

In California, in dissolution proceedings, you will not be able to find an ethical lawyer to help you on a contingency basis, as this considered to be a violation of legal ethics.
If you have an actual judgment which gives you certain rights in specific property or a sum certain and your dissolution is final, you may be able to find an attorney on contingency to enforce the terms of that judgment.
In California, it is unethical for a family law attorney to take a family law case on a contingency basis.
Only if you already have a dissolution-of-marriage judgment can a lawyer take the post-judgment case on a contingency basis to recover part of the community assets and/or estate on your behalf.
