Can i sue the Florida Department of revenue for negligance?

Child Support 2 views 1 answers
The mother of my children filed for food stamps and child support. The children lived with me. We went to court on 10/13/12. I was awarded temporary custody due to her drug and alcohol abuse. The Department of revenue kept sending me notice's saying I was supposed to be paying her child support. It took until June of 2011 for them to switch it even though they had the order the whole time. They took my tax return of $4300 saying I owed her back child support. I called on Feb 14 2012 told them we were going through the court process and to hold my money. We went back to court on 9/05/12 to get an order to release my tax return. Little did we know they ignored my hold request and sent her $3600 in june. So can i sue for damages?

You likely cannot sue the department. You can certainly notify them of the overpayment and have them seek to collect it back from the ex. Do you continue to owe child support? If so, then you can go back to Court and have the Court apply these overpayments to your account. Seek legal help.
