I have judgment against me can I work contract labor without them garnishing my check?

Judgement was filed over 5 years ago. I have been unemployed the entire time. With no income they haven't been able to get any money. ;) my husband is in financial bind now so I am considering contract labor.

You will have some risk by having income, unless the judgment is paid, expired or if you file bankruptcy to discharge the debt. Wages are a typical example of income, except that you are not likely to receive wages for contract labor that you describe in the inquiry. Any assets can be seized, if not exempt, such as an account receivable from contract labor.

If the judgment was over 5 years ago, the Plaintiff must have "re-newed" the judgment prior to its 5 year anniversary prior in order to garnish your wages. However, "contract labor" is not exempt from garnishment provided the judgment creditor Plaintiff: 1) re-newed the judgment by a filing with the Court where judgment was obtained, and 2) discovers where you are employed and sends a garnishment affidavit to your new employer.
