How can I find out if a criminal charge is going to be filed against me or if it has been dismissed?

I made a stupid move with my previous employer and some items were taken. I was questioned by detectives and the property was returned, and I was free to go. I was told I would be contacted by mail or phone is charges were going to be filed against me. That was over two months ago and I have not heard anything further regarding the matter. I have checked with the counties websites for arrest warrants and/or cases filed against me, but there are no records to be found. I am wondering if this is all just going to be dropped, because the property was returned, and I fully cooperated with law enforcement in regards to it, or if I should still be concerned. I don't want to poke around too much in the hopes that this will just go away, but I can't live like this...wondering and worried.

I suggest speaking directly with a criminal defense attorney for a thorough answer.

Under the circumstances that you describe, one of a few possible things can happen. The DA will file a complaint and send you a letter to appear in court; the DA will get an indictment and send you a letter to appear. DA may file complaint or obtain an indictment and get awarrant for your arrest. DA may not do anything. The DA has until the statute of limitations runs to do anything. I doubt seriuosly an attorney is of any benefit , based on your post, at this point [though nothing precludes seeing one for an indepth discussion]. I just would not say anything else to company or law enforcement personnel, period. Your anonymous checking is sufficient for the moment.

Unfortunately, law enforcement may still be conducting investigation regarding your matter. If you are ultimately charged, the potential crimes may be second degree burglary, petty or grand theft, amongst others. It is just too difficult to give you a thorough answers without more specific facts, such as what were the items taken? What was the approximate value? What is your prior record, if any? Depending on whether this will be filed as a misdemeanor or a felony, the statute of limitations allows for the case to be filed within a certain time period. For peace of mind, you should absolutely consult with a criminal defense attorney to discuss all aspects of the case.

If you are just waiting to see if charges are filed, checking with the court or sometimes the prosecutor's office is all you can do to find out if a case is filed. If you are trying to work to keep the case from getting filed, you should talk to a local criminal defense attorney so he/she can look into it, possibly even contact your former employer if that is approrpriate under the circumstances. A couple of months is not necessarily a long time for a case to make its way throught the system an result in a warrant, especially if it is a misdemeanor.
