CA DS702 form and 2nd DMV hearing

DUI 2 views 4 answers
The DA signed my DS702 form stating that my 2nd DUI over.08% was dismissed due to all evidence being supressed (bad stop by the officer). I sent the DMV HQ the DS702 already. What are the percentages a lawyer can win my 2nd hearing after losing the first. Yes, I know the DMV people are dense and usually won't listen to reason... that's why I'm worried!

With a judge finding an illegal stop/arrest and a good DUI attorney you have a very good chance of winning the DMV hearing. Look to the California DUI Lawyers Association for a list of good attorneys.

It depends on so, so many factors, starting with which DMV hearing officer you get. In San Diego, some are rubber-stampers, and some will actually listen. From there, it depends on what the technical issues are, and why the DA agreed to sign the DS 702. Very round hands-off answer, I know..but it really depends on so many factors.

If you have a good DMV lawyer you should be in great shape.

Way to many factors involved to give a percentage or prediction of success. You do appear, however, to be in the best shape possible given the circumstances.
