Do I have to sign a marriage settlement agreement?

4 views 2 answers
I was handed papers a month and a half ago to consent to divorce. I signed them and his lawyer was late to submit them. New batch comes and with this one is a marriage settlement agreement. We have no mutual debt or property. Child custody was done a year ago. Do I have to sign this agreement?

You do not have to sign the agreement. If you do not sign, however, your spouse's attorney can move upon the Court to finalize the divorce without your consent if statutory conditions are satisfied. It will depend upon which section of the Pennsylvania Divorce Code your spouse's attorney proceeds. You will have to follow up if your spouse serves you with a divorce complaint in order to protect your rights.

It depends on the settlement. You should consult with an attorney to make sure that the settlement proposed is equitable or at least a deal you are willing to live with. Michael Kuldiner, Esq.
