A lot will depend on the specific facts. Are you a citizen? Did you sign any prenuptial contract? There's a lot of other questions that my matter as well. Get a family law attorney right away. It is possible you may be eligible to have him pay your attorney's fees based on need. It sounds like you definitely have some rights here that you will want a lawyer to help you enforce. Otherwise, you could call SMRLS to see about getting an attorney for free. Good luck to you in the case and with nursing.

A question like "what are my rights" is too broad to answer here. I recommend that you read the articles on my web page to gain an understanding of your rights in divorce. www.minnesotadivorce.com. As to your specific question, the answer is "no", he does not have the right to kick you out of the house. If he does, you should call the police.

It is important that you contact an attorney who is familiar with immigration issues as well - there can be consequences when sponsoring someone's immigration to the US. Depending on your immigration status, your husband could very well be responsible for your financial viability given his sponsorship of you. In fact, if you were to apply for government benefits, it could be such that he would have to repay the social services agency that provides the benefits, as your sponsor. In my experience, the court is also often more open to awards of temporary spousal maintenance in a situation such as yours. I would recommend setting up a consultation with an attorney that you trust ASAP. Best of luck!
